Images of old paintings
Hi Lord Cornwallis. I've noticed you've recently upload a number of files of old paintings like File:Cleopatra and the Peasant.jpeg locally to Wikipedia. You might want to take a look at c:Commons:When to use PD-Art because most of your uploads are probably OK for Commons. Files uploaded locally to English Wikipedia are limited technically to being used only on English Wikipedia, even when they're licensed as public domain; files uploaded to Commons, on the other hand, can be easily used by any of the various language Wikipedias or other WMF projects. So, Commons is better suited to hosting such files since its setup is global and works well with all WMF projects. As long as you're reasonably sure the the paintings are no longer eligible for copyright protection in both the US and their country of first publication, they should be fine for Commons. If you've got any doubts, you can always ask for input at c:COM:VPC.
As for the files you've already uploaded, you can relicense them as {{PD-Art}}
, a local English Wikipedia version of the Commons "PD-Art" template, in combination without another license like {{PD-US-expired-abroad}}
(with the parameter |pdsource=yes
used to indicate the painting is also PD in its source country; for example, {{PD-Art|PD-US-expired-aborad|pdsource=yes}}
.) to tweak their respective licensing to something a little more appropriate while simultaneously tagging the files for a move to Commons. The {{PD-US-expired}}
license you used isn't wrong per se, but the "PD-Art" license contains additional wording to cover any possible copyright concerns about the photo of the painting (these photos almost certainly aren't as old as the painting themselves) and the "PD-US-expired-abroad" makes it clear that the painting was first published outside the US and is also PD in its source country. For reference, such photos, for the most part, are considered to be slavish reproductions (i.e. lacking sufficient creativity to establish a new separate copyright for the photo itself) under US copyright law and by Wikimedia Commons, but the "PD-Art" license just makes that a bit clearer. -- Marchjuly (talk) 07:35, 13 February 2025 (UTC)
