• Keep - The copyright of the work is owned by the creator, regardless of whether personality rights were infringed by the creator's subsequent use of Techno Viking's image and likeness. The fair use rationale is also reasonable, since it is used to identify the subject of the article. I am not convinced that by removing the photo from Wikipedia we are doing them a service, since the image and full video is trivially accessible from elsewhere on the internet. • Wikipedia only cares about the laws of the United States. The court ruling is from Germany, and German law is different to US law in this aspect: Germany lacks freedom of speech. Wikipedia also do cares about German law, for example in establishing copyright status. See, for example, the guidelines at WP:Non-U.S. copyrights where foreign copyright status is key to establishing whether the file can be freely used on Wikipedia or not. There are also local Wikipedias which more striclty follow local laws.

For example, in my country, the government recently decided to make it illegal to hide cameras at toilets and take photos of people without telling them. You repeat yourself, and also seem to be confusing a discussion with litigation.
