- By looking at this picture, obviously shot in the desert of Kuwait and than looking at the upload record of the uploader, I simply don't believe he is the copyright holder of it, until further evidence is given. - Keep. It's not at all "sans commentary". There are several paragraphs on the use of Tchaikowsky's skull in RSC productions in each article, which speak specifically to the use of this human skull as opposed to a replica prop. As such, an image of the skull being used in a production of Hamlet adds to the reader's comprehension of the text. No free equivalent image can exist, since photographs of a theatrical production are restricted by the show's producers, and the production in question has closed. The commentary explaining the historical significance of that particular skull is transformative, changing what might appear as a photograph of an actor with a prop into a photograph of an actor with a human skull donated for use in productions of this particular play. —Josiah Rowe (talk • contribs) 16:49, 24 March 2009 (UTC)[reply]

- Keep. There is quite a bit of commentary in the Yorick article and there are no other images that "illustrate the use of a skull in productions of Hamlet", contrary to what Jonathunder asserts. - But the point is we don't need to see the use of this particular skull. You can't tell from the skull that it comes from a specific human being. Heck, with modern props you wouldn't even be able to tell the difference between a real and an artificial skull.

- To me, that suggests that all skulls are interchangeable, which runs rather contrary to both Tchaikowsky's wishes and Hamlet's speech: "That skull had a tongue in it, and could sing once." There's an undefinable frisson which comes from the knowledge that you're looking at a particular human skull, as opposed to a fake prop. The article discusses the effect which using Tchaikowsky's skull had on the actors and the audiences when it was used. Now, not every reader will be so affected by merely seeing the photograph; but I think that some will, and that using this photograph illuminates the text in a unique fashion. - For the sake of argument, let's assume that you're correct (I dispute this, but whatever). Even if this were the case, you still have a news agency photo that belongs to the BBC, and we've specifically forbidden those at WP:NFC#Unacceptable use images #6 -- the event is the subject of commentary, NOT the photo itself. - It's sourced to the BBC, but it belongs to the RSC. See picture #15 here. This image was part of a press pack sent out by the RSC to media sources. It was also used by the Guardian, the Telegraph, Time Out and other sources. The Telegraph credits the photo to the AP, but the Guardian credits it to Ellie Kurtz and Time Out says "© Ellie Kurtz/RSC". A little research finds another reference to Ellie Kurtz as a photographer working with the RSC here. If the image originated in an RSC press package, but was subsequently distributed by the AP, that doesn't make it a photo from a press agency. Thus, unless you are blessed with telepathy, there's no way for us to know if the uploader will agree to that without asking. - Comment - Nonsense. This image was released by the State of California of an incarcerated indevidual, and NO OTHER recent image of this indevidual exists. This image is the latest image of a notable individual Charles Manson (it is his latest mug shot, it does not resemble ANY OTHER image of this indevidual), and was released to the public by the State of California. - Keep and Response - In fact, there is a difference between being released to the public, which implies public domain and free use, and the licensing criteria of the state of California. The licensing on the image says clearly "The state forbids any copying or use other than "fair use" under the Copyright Act. "Fair use" includes activities such as criticism, comment, news reporting, teaching, research, and other related activities. For the purposes of Wikipedia, this is a non-free license and must have an accompanying "fair use" tag and criteria." There is also a difference in mugshots and routinely updated photos taken for identification purposes in an institution.
