"Promotional" is not a license. You are asking whether this image might be used without a license, under the non-free content criteria. In order for the image to be used under this criteria, in particular it must be established that the use of this image in the article Indonesian Wikipedia meets criterion 8, namely, that "its presence would significantly increase readers' understanding of the topic, and its omission would be detrimental to that understanding." I don't see anything that would be lost if the image were removed from the article—the information that this magazine included a CD of the Indonesian Wikipedia is already conveyed through the text. • Can't see how an image can be original research. In that it isnt used in article space I guess that it is obsolete. It might be a candidate to move to commons, however, without wishing to get into a legal maze of copyright which I dont understand properly, I have concerns about the intention of the original author (who it appears did not upload it) when they "scuttled" the image to reduce its commercial use, and what use they intended for it. • Yes, I did. We can only use a couple images. The page lists every character in the series and has an image for each. We could probably keep maybe one or two for the most important charactesr, but given that I've not seen the cartoon I don't know which are the most prominent characters. She is an underground manga artist who does not do interviews and was in a disfiguring car accident years ago. It is very unlikely that any other images of her will ever surface (free or non-free). The photo is very low resolution, and is a press photo that originally comes from the back of one of her comics. I'm not sure if this is the right place to make this note, I'm new to this process. Specifically of a "lower resolution that would be unlikely to impact the copyright owners ability to resell or otherwise profit from the work". Personally I think the photo is very useful. Whether or not it is hard to obtain an image of the person in question is a non-issue. The person is alive. Therefore, this image can not be kept. I just want this article to feel complete, and having her picture on it is really important to me. I value your dedication to the cause, can't we work this out while keeping the image? I think making an exception to the rules in this situation is the right thing to do. If someone actually CLAIMS copyright, then I also support removing the image. I care about wikipedia too. • That the rationale has been improved doesn't change the fact that this is a non-free image of a living person. The simple fact is the Foundation has ruled directly against the use of fair use images to depict living people. She is still alive. Disfigured or no, she is still alive. I can't tell you how many times people have tried to use the argument that getting a free image of the person is either impossible or so unlikely as to be impossible. Yet time and time again, I've seen free license images suddenly found when the fair use ones fail review. This person is alive. She's not even that old. She could live another 40, 50 or 60 years. Predicting that she will never ever be seen in public over the next many decades is an empty argument. Further, we don't retain non-free content until free content is available. If it is possible for free content to replace non-free content, then we do not accept the non-free content. "Non-free content is used only where no free equivalent is available, or could be created" (WP:NFCC). This policy does not say "Non-free content is used only where no free equivalent hasn't been found or contributed yet". The Foundation ruled directly on this particular usage for living people at Foundation:Resolution:Licensing policy article 3.
• Now, if the image had some historic significance, for example showing her involved in an historically important event that the article discusses in some depth, then there'd be a case to retain the image. But that's not the usage here. The usage here is strictly for depicting her. The image is not discussed in the article. It's not historically significant.
• All across the project, fair use images of living people for depiction are simply not used. It's not a question of there being lots of exceptions, and case by case analysis. We just don't do it. Period. That's why I've been removing the image from the article, because it's a clear, clear, clear cut case where we simply do NOT use an image like this for this purpose. We just don't.
• If you're mad about other people undoing your actions that are in blatant violation of our policies, I recommend you reconsider your stance as you will frequently become angry here. I'm sorry that having a fair use picture of her is really important to you, but we do not edit Wikipedia by your rules. We do so by our policies and guidelines. Sometimes I don't like them either. But, I edit here with the understanding that I will act in accordance with those policies and guidelines.   • Hammersoft, I'm not trying to blatantly violate anything. I read the rules very carefully. On the upload page, when you select Fair use image of a living person it states:

    Kyoko Okazaki is a recluse. She is physically disabled and deformed from her accident. Also, here Wikipedia:Image_copyright_tags/Non-free_content#Publicity_photos it states:
    
    Fair use on Wikipedia only applies if it is not possible to replace such publicity image with a free image. {{Non-free promotional}}—for publicity photographs of people or events, such as headshots or posed shots, from a press kit. See Wikipedia:Publicity photos.
    
    The photo is a publicity photo. This photo meets two of the requirements allowing non-free images. So don't insult me. You can claim that a free image may reasonably become available, but as I see it, since neither of us knows her personally, that is strictly a matter of opinion. Ultimately, if my ideas about wikipedia are correct, you are not the judge. This is a community project, and check the history of the Kyoko Okazaki page, you will see that there are 2 people besides myself who have been adding the photo back to the page. • (to Asakawano) I never insulted you. If you feel that I have, please accept my apologies. As to how these issues are handled, there is no 'vote' for things like this. Precious few things on Wikipedia operate under a vote (the current ArbCom elections are one case where it is a vote). We operate on consensus, policy and guidelines. An extreme example in practice; if 9 people in a deletion discussion voice an opinion to keep an image and all 9 of them state their reason as "i like it", and one person said to delete it because it's a verifiable copyright violation, consensus might seem to be to keep the image. In fact, the closing admin will most likely close the debate as delete, because the 9 in favor of keeping failed to cite any policy to keep the image or rebut why it is not a copyright violation. That's policy in action.
• In general, the "recluse" argument frequently fails. The reason is that there have been multiple cases where such a claim was made and subsequently free imagery was obtained. We're not looking into crystal balls and attempting to divine people's intents for the rest of their lives. In Okazaki's case, she may find that after 12 years of not publishing, her royalties may slowly dry up, forcing her to once again begin publishing and venturing out into public to promote her works. We can't divine that sitting here at our computers wondering about the future. She's still alive, and most likely will be for decades to come. A case that does work and has worked in the past is for example a convict who is on death row. Obtaining free imagery of such a person is effectively impossible. Such things are judged on whether obtaining imagery is possible, not on whether it is hard. How hard it is to obtain an image isn't a factor.
• In this specific case, some editor here could contact her press agent, her family, etc. to obtain release of a free license image. Information on how to do that is located at Wikipedia:Requesting copyright permission. At a bare, bare minimum until that avenue is explored and fails, it must be considered possible to obtain free imagery of her. Since it remains possible, this fair use image isn't acceptable.
• As to me being a judge, I am not a judge. I do claim to be a certified idiot. I also claim that because I am not an administrator, I am therefore probably trying to disrupt the project, or is at least grossly incompetent. See my userpage for more information on that count. I can say that I am considerably experienced in Wikipedia's image use policies and debates surrounding those policies. I am taking the opportunity, as I do in many such discussions, to educate people who do not yet know how such issues are handled here.
• A quick summary in that vein; while the Foundation does allow that there may be exceptions, in practice the exceptions are virtually non-existent. This is a hard and fast enough rule that if the person is alive, there's usually an automatic presumption that we won't accept a fair use image to depict a living person. In the vast majority of cases, such images never see an IfD. They're simply removed from articles, tagged as orphaned, and deleted after several days. If the uploaders protest the decision, they're informed of the policy and the image is still deleted. • To asakwano; and here's a case example of what I spoke about above. A user has voiced their opinion to keep, but has failed to rebut the policy considerations on why this image should be deleted according to some, or has failed to provide a basis in policy under which this image should be kept. An easy rebuttal to this opinion by Joshua Issac is to say "keeping will not help Wikipedia". My personal preference is that we get rid of every non-free image except for iconic works like the Iwo Jima flag raising or the Kent State shootings where the copyrighted work is so intrinsically important to a discussion of the subject that it is not possible to have an article without it. But that's not our policy. Our policy is that we potentially allow a non-free image to be used unless "we can reasonably expect someone to upload a freely licensed file". That is obviously not the case here as nobody can reasonably expect a free photo of this woman to be uploaded. • Comment - this image should be kept because no free alternative exists. Foundation:Resolution:Licensing policy states:

An EDP may not allow material where we can reasonably expect someone to upload a freely licensed file for the same purpose, such as is the case for almost all portraits of living notable individuals."

We cannot reasonably expect someone to upload a freely licensed photograph of the subject, therefore this image should be an exception. How hard it is to obtain a free image is a factor, otherwise the word reasonably would not have been omitted. It is possible to obtain a photograph of a convict who is on death row , but it would be very hard to do so. You have stated that "the Foundation does allow that there may be exceptions, in practice the exceptions are virtually non-existent". • Certainly we can. The subject of this image is not in prison. She's not prevent from appearing in public by any external entity. She can, at any time of her choosing, make a public appearance. She will probably live for decades yet. I think it important to point out here that it is not for the people who are against fair use to defend why it isn't allowed. It is for the people who wish to use a fair use image to come up with a very strong case why a fair use image should be allowed in the first place. The default case is to not allow. Prove why it should be allowed. In this case, that proof is starkly absent.
