This is being done as part of Wikipedia:Contributor copyright investigations/Indian Education Program. I don't quite know what to do with this: I'm not entirely sure about whether the uploader is the author, as there appears to be another name attached to the file elsewhere on the web. This person claims the rights, along with several similar photos of the same scene (although he's uploaded it at a later date). His profile and that of the local uploader do not match. Our uploader has had most of his files deleted due to lack of licensing information. Perhaps some helpful admins could look at the deleted files for any similar situations. If there aren't any, perhaps assume good faith? I'm not sure, so I'm passing the buck here. Osiris (talk) 18:39, 4 February 2013 (UTC)[reply]

Non-free photograph of a prize winner in an athletic competition. While the prize was arguably historically important in the context of its discipline, there is nothing special about this photograph that would help to understand the article better. Wikipedia has thousands of articles on important athletic races, matches and similar achievements. We never use non-free photographs of the prize ceremonies, because they are entirely predictable and always the same: the winner is happy, smiles, and waves. It's no different here. There is no reason at all to treat this scene differently from the thousands or tens of thousands of prize ceremonies at all other athletic events. Fut.Perf. ☼ 20:09, 4 February 2013 (UTC)[reply]
- This is an unusual case though. The event had particular significance in Australia, with a big lead up at the time - there was talk about how the cup was bolted down, and they had a special gold spanner made to undo it for the ceremony, along with talk at the time that they wouldn't be allowed to be given the cup at all. The ceremony itself was the first in the 135 years, as no challenger had won the race since the US took the cup the first time, so the ceremony was an extremely unusual historical event. - Bilby (talk) 22:01, 4 February 2013 (UTC)[reply]

- Keep This is one of those cases where there are no free images of the artist in question available. (The uploader in question, Leahtwosaints, is known for her ability to find free images, including getting photographers to change the rights they have published under, so if she can't find one, that's saying something.) The album in question, Daydo, isn't really significant enough to have its own article. So I don't think WP:NFCC#8 applies here - the presence of the image does significantly increase readers' understanding of the topic, because without it, they will have no idea what the subject of this biographical article looks like. As for the fair use boilerplate text - "The image is used for identification in the context of critical commentary of the work for which it serves as cover art" - yes, that is true, as whatever critical commentary of the album exists in WP, exists in this article. - If the purpose of this non-free image is to illustrate the appearance of the artist then it's a failure of WP:NFCC#1 as he is still alive (and even still performing according to the article). Just because a free image has not yet been found does not mean one can not be created. See also WP:NFC#UUI #9 -- if the cover art had sourced commentary, then this use would be acceptable.
