Though the picture is originally copyrighted I (Spawn Man) feel it is covered by fair use because:

1. it is a low resolution copy of a comic book cover;
2. it does not limit the copyright owners rights to sell the comic book in any way;
3. copies could not be used to make illegal copies of the comic book;
4. the panel in question illustrates a noteworthy aspect of the character Amygdala;
5. it is one of the first times Amygdala was featured on a cover, if not the first & if not the last;
